PROPERTY OFFENSES

Property crimes are frequently charged, especially in a down economy.  Fortunately, as an experienced WA criminal defense attorney, I know how to best defend against these charges.

THEFT 3rd DEGREE

A Theft conviction is very serious because employers do not like to employ thieves and it could affect any future testimony you give in court.

Theft is to wrongfully obtain or exert unauthorized control over the property or services of another or the value thereof, with intent to deprive him or her of such property or services. Theft in the 3rd Degree occurs when the property is valued up to $250 and is a Gross Misdemeanor, which carries a maximum sentence of 364 days in jail and a $5,000 fine.

SHOPLIFTING

Shoplifter is covered under the Theft statute.  The value of the goods will determine the degree of Theft that a person may be charged with.

CRIMINAL TRESPASS

Criminal Trespass is a serious charge like other criminal charges and should not be treated lightly by those accused of this crime. A criminal defense attorney is needed to properly defend against Criminal Trespass charges.

CRIMINAL TRESPASS 1st DEGREE

A person is guilty of criminal trespass in the 1st degree if he knowingly enters or remains unlawfully in a building. This charge is a Gross Misdemeanor, which carries a maximum sentence of 364 days in jail and a $5,000 fine.

CRIMINAL TRESPASS 2nd DEGREE

A person is guilty of criminal trespass in the 2nd degree if he knowingly enters or remains unlawfully in or upon premises of another under circumstances not constituting criminal trespass in the 1st degree. This charge is a Misdemeanor, which carries a maximum sentence of 90 days in jail and a $1,000 fine.
